Terms & policies

Last updated 2026. These documents govern your use of PinnVPS, a service of Momentum Minds LLC (New Mexico, USA). Read carefully — using the service means you accept them.

Privacy policy

Momentum Minds LLC ("PinnVPS", "we", "us") respects your privacy. This section describes what we collect, why, and what you can do about it.

1. Information we collect

When you open an account or use our website, we collect the information you provide: name, email, billing address, payment instrument details (tokenized, never stored in plaintext), and any communication you send to support. We log technical data automatically — IP address, user agent, request URLs, error traces — for security, abuse prevention, and capacity planning.

2. How we use your information

We use account data to provision and bill your services, prevent fraud, comply with US tax law, and answer your support requests. Aggregated and anonymized data may be used to improve the product. We do not sell personal information.

3. Sharing your information

We share data only with: (a) payment processors required to collect funds (Stripe, PayPal); (b) infrastructure subcontractors operating our datacenter footprint, under contract terms equivalent to ours; (c) law enforcement when compelled by valid US legal process. We do not share with advertisers or data brokers.

4. Cookies and tracking

We use first-party cookies for session management and a privacy-respecting analytics setup to count page visits. We do not run ad-targeting cookies. You can refuse cookies in your browser; some features (login persistence) will degrade.

5. Data retention

Account and billing records are retained for seven years to comply with US tax and accounting requirements. Server contents — files inside the VPSes you operate — are your responsibility; we do not retain them after service termination beyond the standard 72-hour backup rotation, after which they are permanently destroyed.

6. Security

We follow industry-standard practices: TLS on every public endpoint, encryption-at-rest for sensitive fields, principle-of-least-privilege for internal access, audited logs for administrative actions. No system is impervious; we promptly disclose material breaches to affected customers in accordance with US state and federal notification laws.

7. Your rights

You can request a copy of the data we hold on you, request correction or deletion, and close your account at any time. Write to [email protected]. Subject to applicable US state privacy law (CCPA, CPRA, VCDPA, etc.), we respond to verified requests within 30 days.

8. Children

PinnVPS is not intended for use by anyone under 18. We do not knowingly collect data from minors. If we learn a minor has an account, we close it and delete associated data.

9. Data location

Our datacenter footprint is located entirely within the United States. By using PinnVPS you consent to data being processed in the United States, in the region you select. US customers are covered by applicable US state privacy law (CCPA, CPRA, VCDPA, etc.).

Terms of use

1. Agreement

These Terms form a binding contract between you ("Customer") and Momentum Minds LLC ("PinnVPS"). By creating an account or activating any service you accept them in full.

2. Changes

We may update these Terms by posting a revised version on this page and recording the change date. Material changes are emailed to active customers. Continued use 30 days after notification constitutes acceptance.

3. Services offered

PinnVPS provides virtual private server hosting and related services on infrastructure operated by us or contracted by us. Specifications, prices, and inclusions appear in the order page and the Knowledge Base; the order confirmation is authoritative.

4. Eligibility & account

You must be at least 18 and legally able to enter contracts in your jurisdiction. You are responsible for maintaining account credentials. Actions taken via your authenticated session are attributable to you.

5. Restricted jurisdictions

We do not provide service to any person or entity located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive US sanctions (currently Cuba, Iran, North Korea, Syria, the Crimea, Donetsk, Luhansk, and Zaporizhzhia regions, as updated by OFAC). Accounts found to violate this section are terminated and funds may be frozen pending compliance review.

6. Acceptable use

You must not use PinnVPS for, or in connection with:

  • any activity prohibited by US federal law or the law of the customer's country of residence;
  • distribution of child sexual abuse material, in any form, no exception;
  • unsolicited bulk email ("spam") or activities that get our IP ranges blocked by reputable spam databases;
  • port scanning, vulnerability scanning, brute-forcing, or otherwise probing systems you do not own;
  • operation of public DNS resolvers without rate-limiting (open resolvers used for amplification attacks);
  • distribution of malware, ransomware, or command-and-control servers for malicious botnets;
  • any activity that overloads, interferes with, or degrades our shared infrastructure or that of third parties.

The list is illustrative, not exhaustive. We use commercially reasonable judgment to apply it.

7. Law-enforcement cooperation

We cooperate with valid US legal process — court orders, subpoenas, search warrants — and may disclose customer data without notice where the process forbids notification. We do not perform proactive surveillance and do not disclose data on informal request.

8. IP addresses & network resources

IP addresses are leased to you for the duration of your service and revert to us upon termination. We rotate IPs found in major spam databases. Reverse DNS is supported on request via ticket.

9. Fees, billing, and taxes

Services are prepaid. Invoices are issued at the start of each billing cycle and due immediately. Unpaid services are suspended after seven days and terminated after thirty. Prices are quoted in USD and exclusive of any applicable sales, use, or value-added taxes; you are responsible for taxes in your jurisdiction.

9.1 Auto-debit authorization

By activating a service you authorize Momentum Minds LLC to charge your stored payment method automatically on each billing date for the recurring fees of services you have ordered. The first charge is processed on the Account Activation Date — the moment your service is provisioned. Subsequent charges occur on the same calendar day each billing cycle (or the nearest preceding business day for months that lack the corresponding date). You may change your payment method at any time in your client area; you may cancel the auto-debit only by cancelling the underlying service.

9.2 Bandwidth and traffic

Each plan includes a monthly bandwidth allowance shown on the order page (e.g., "5 TB / mo"). Allowances reset on each billing date. We do not artificially cap or shape traffic up to the listed allowance — the line speed shown is what you get.

Once an allowance is exhausted, one of the following applies, at our discretion and based on what causes least disruption to your workload: (a) the port is shaped to 100 Mbit/s for the remainder of the billing cycle; (b) overage is metered and billed at the published per-TB rate (currently US$3.00/TB, subject to change) on the next invoice; or (c) for sustained sustained-burst customers, we contact you to discuss moving to a higher-allowance tier. We do not silently bill large overages without communicating first.

You must not knowingly run workloads that degrade shared network capacity for other customers — large-scale unsolicited mailing, persistent DDoS-style amplification by your application, runaway loops generating wasted egress, etc. Sustained patterns of this kind are treated as Acceptable Use violations.

9.3 No proration of partial months

Monthly fees cover the full calendar billing cycle they apply to. Cancelling a service mid-cycle stops further renewal but does not generate a partial-month refund, except as expressly provided in the Refund Policy below.

9.4 Reactivation

If your service is deactivated for non-payment and you wish to restore it within the data-retention window (30 days from deactivation), a reactivation fee of US$20 per service applies in addition to the outstanding balance. Data on services terminated for more than 30 days cannot be recovered.

9.5 Setup fees

Standard KVM VPS plans carry no setup fee. If you order a service that does carry a setup fee — for example a custom hardware build, a non-standard licence, or expedited migration assistance — the setup fee is itemised on the order page and on the resulting invoice, charged once upon activation, and non-refundable.

9.6 Payment methods

We accept Visa, Mastercard, and American Express (via Stripe), and PayPal, as self-serve payment methods. Cryptocurrency, wire transfer, and ACH are available upon request via support ticket. Chargebacks initiated without first contacting support may result in immediate service termination and a one-time chargeback recovery fee equal to the chargeback amount plus US$50.

9.7 Right to refuse service

In addition to suspension or termination for breach (covered in Section 17), Momentum Minds LLC reserves the right to refuse, decline to renew, or discontinue a service at our reasonable discretion — for example, where an order pattern looks fraudulent, where a workload poses an outsized abuse-handling burden, or where servicing the customer would require infrastructure changes we are unwilling to make. Where we refuse or discontinue service for reasons unrelated to breach, we refund any prepaid amounts for unused periods on a prorated basis.

10. Service levels & maintenance

We operate the network and host hardware on a commercially reasonable best-effort basis with redundant power, redundant transit, and active monitoring. We do not offer a contractual uptime SLA or service credits. Planned maintenance is announced at least 72 hours in advance.

11. Backups & data responsibility

We provide rolling 72-hour automated backups as a convenience. They are best-effort and not a substitute for your own backup strategy. You are solely responsible for data on your VPS; we accept no liability for data loss.

12. Intellectual property

The PinnVPS brand, website content, control panel UI, and supporting documentation are the property of Momentum Minds LLC. Software running inside your VPS is governed by its own license terms; you are responsible for licensing what you deploy.

13. Third-party software

Operating-system images and pre-installed software are provided "as is" by their respective vendors. We make no warranty as to fitness for any particular purpose.

14. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

Our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or loss of data, even if advised of their possibility.

16. Indemnification

You agree to defend and hold harmless Momentum Minds LLC from any claim, loss, or expense arising from your use of the Service in violation of these Terms or applicable law.

17. Suspension & termination

We may suspend or terminate service immediately for breach of these Terms, non-payment, or activity that puts the broader platform at risk. You may terminate at any time by cancelling in your client area; cancellation stops renewal but does not retroactively refund the current cycle except per the Refund Policy.

18. Force majeure

Neither party is liable for failures caused by events beyond reasonable control — natural disasters, war, civil unrest, government action, internet backbone failure, etc.

19. Governing law

These Terms are governed by the law of the State of New Mexico, United States of America, without regard to conflict-of-law principles. The state and federal courts located in New Mexico have exclusive jurisdiction over disputes, except as provided in the Arbitration section.

20. Arbitration & class-action waiver

Any dispute that cannot be resolved by good-faith negotiation will be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in English in New Mexico, USA. You and PinnVPS each waive the right to participate in any class or representative action.

21. Miscellaneous

If any provision is held unenforceable, the remainder remains in effect. Failure to enforce a right is not a waiver. These Terms, together with our Refund Policy and DMCA Policy, are the complete agreement between us on the subject. You may not assign your rights without our written consent; we may assign in connection with a merger or acquisition.

Refund policy

1. Service-defect refund window (48 hours)

If, within 48 hours of provisioning, your service exhibits a verified defect on our side — failure to deploy, persistent hardware fault, or sustained network unreachability our engineering team cannot resolve — you may request a refund. We will diagnose the issue first; refunds are issued where the defect is confirmed and not attributable to your configuration, software, or account behaviour.

2. No change-of-mind refunds

Refunds are not available for reasons unrelated to a service defect — including "I don't want it anymore", choosing the wrong tier, regret over a configuration choice, broker compatibility surprises, performance not matching subjective expectations, or any cancellation initiated by you that is not tied to a confirmed defect on our infrastructure. Once delivered as ordered, the service is non-refundable.

3. No refunds on cryptocurrency payments

Cryptocurrency payments are non-refundable in all circumstances, including service-defect cases. Customers paying in crypto who experience a service defect within the 48-hour window may instead request equivalent account credit toward a replacement service or a future invoice.

4. Other exclusions

Refunds are not available on: custom hardware builds, customised configurations, add-on services or licences once activated, services suspended or terminated for breach of these Terms, partial billing periods (see Section 9.3), or any service paid for in cryptocurrency.

5. Procedure

Open a refund request via ticket within 48 hours of provisioning. Identify the order and describe the defect in enough detail for us to reproduce it. We respond within one US business day; approved refunds are processed within five business days to the original payment method where technically feasible.

6. Renewals

Recurring renewals are not refundable. Cancel the service in your client area before the renewal date to avoid renewal charges.

Responsibility for illegal data

You are the data controller and processor for content you place on your VPS. Momentum Minds LLC is not aware of, and is not responsible for, the content you store or transmit. On receipt of a credible complaint that your service hosts unlawful content, we may suspend the affected resource pending investigation. Cooperation with valid US legal process is described in the Terms of Use.

DMCA / copyright policy

1. Designated agent

Copyright complaints under the US Digital Millennium Copyright Act ("DMCA") may be sent to our Designated Agent: [email protected] with the subject line "DMCA Notice".

2. Filing a notice

A valid notice must include: (a) physical or electronic signature of the rights-holder or authorized agent; (b) identification of the copyrighted work; (c) the URL of the allegedly infringing material; (d) your contact information; (e) a good-faith statement that the use is unauthorized; (f) a statement under penalty of perjury that the information is accurate and you are authorized to act for the rights-holder.

3. Counter-notice

If your content was disabled in response to a DMCA notice you believe was incorrect, you may file a counter-notice including the same identifying information and a statement under penalty of perjury that the takedown resulted from mistake or misidentification. We restore content 10–14 business days after receipt of a valid counter-notice unless the complainant initiates court action.

4. Repeat infringers

We terminate, in appropriate circumstances, the accounts of customers who are repeat infringers.

5. Safe-harbor

We claim the protections of 17 U.S.C. § 512(c) and reserve all defences available under US law.

Acceptable use policy

This Acceptable Use Policy ("AUP") expands on Section 6 of the Terms of Use and applies to every PinnVPS service and to anyone using one. Violation may result in throttling, suspension, termination, or referral to law enforcement, with no obligation to refund.

1. Illegal activity and third-party rights

No content or activity that violates US federal law, the law of New Mexico, the law of any jurisdiction where you or your users are located, or the rights of any third party. This includes — without limitation — fraud, identity theft, defamation, hosting of stolen material, and infringement of intellectual property.

2. Network and infrastructure abuse

No DDoS attacks, no participation in or coordination of attacks, no unauthorised port-scanning or vulnerability-scanning of systems you do not own or have written permission to test, no open recursive DNS resolvers, no open SMTP relays, and no operating reflectors or amplifiers of any kind.

3. Unauthorised access

No attempting to access systems, networks, or accounts you are not authorised to access. No interference with security mechanisms — yours or anyone else's.

4. Malware and harmful content

No hosting, distributing, or commanding malware, ransomware, botnets, RATs, stealers, or any code intended to compromise systems. Zero tolerance for child sexual abuse material (CSAM); detection results in immediate termination, data preservation, and report to NCMEC and law enforcement.

5. Spam and unsolicited messaging

No unsolicited bulk email, SMS, or any other unsolicited messaging. No purchased mailing lists. Outbound SMTP from new VPS instances may be subject to verification or rate-limited until trust is established. No interference with anti-spam systems — including SPF spoofing, DKIM bypass, or bounce manipulation.

6. Resource abuse

No sustained activity that materially degrades the performance of other tenants sharing the same hardware. Cryptocurrency mining is not permitted on any PinnVPS plan; detected mining will result in resource limiting and, on continued or repeated detection, suspension of the affected service.

7. High-risk anonymity and abuse-prone services

No Tor exit nodes. No public open proxies. No anonymous remailers. Tor relays and bridges, and VPN-for-end-users services, are permitted only with prior written approval and a documented abuse-handling process.

8. Circumvention and resale

No circumventing our rate limits, technical restrictions, or commercial terms — including reselling capacity not licensed for resale, or splitting an account to evade per-account limits.

9. Enforcement

We investigate abuse complaints. Where a complaint is credible and time-sensitive — for example, an active phishing site or an outbound DDoS — we may suspend the affected service without prior notice and contact you afterwards. Non-urgent matters give you a chance to remediate first. We cooperate with valid US legal process; we do not give advance notice when prohibited from doing so.

Cookie policy

This policy describes the cookies and similar technologies we use on pinnvps.com and on the client area at my.pinnvps.com. It supplements the Privacy Policy above.

1. What cookies are

Cookies are small text files set by a website and stored by your browser. They let a site recognise the same browser between requests. We distinguish first-party cookies set by us from third-party cookies set by services embedded on our pages.

2. Essential cookies

Strictly necessary for the site and client area to function. These include the session cookie issued when you log in, CSRF tokens, and cart cookies during the order flow. They are first-party and cannot be disabled without breaking the service.

3. Performance and analytics

We use Google Analytics 4 (gtag, measurement ID G-1RC48HT4NX) to understand how visitors navigate the site and where the funnel breaks. Analytics data is aggregated; we do not use it to target individual visitors. You can opt out via the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout.

4. Functional cookies

Remember non-essential choices such as your preferred datacenter on the order form and whether the FAQ accordion was last opened. First-party.

5. Third-party tools embedded on the site

Tawk.to powers our live-chat widget and sets cookies for session continuity. Trustpilot sets cookies on pages that embed their review widget. Both have their own privacy policies; declining their cookies at the browser level will limit those embedded features.

6. Controlling cookies

Every major browser lets you block all cookies, block third-party cookies only, or clear stored cookies. Where required by local law — for example in California or other US states with comprehensive privacy laws — we display a consent control; in other jurisdictions the supported route is your browser-level settings and the vendor opt-outs above.

Chargebacks and payment disputes

1. Contact us first

If you believe a charge is incorrect, open a ticket before contacting your card issuer or PayPal. We resolve most billing disputes within one business day. Initiating a chargeback or PayPal dispute without contacting us first deprives both sides of that opportunity and is treated as a material breach of these terms.

2. How we handle disputes

When we receive a dispute notification we provide the card scheme or PayPal with the order record, IP address used, communication history, and any abuse logs relevant to the account. We keep you informed of the outcome through the email on file.

3. Fraudulent or abusive disputes

Initiating a chargeback for a service that was delivered as ordered — or after the service has been used to send spam, host abusive content, mine cryptocurrency, or otherwise breach this AUP — is treated as payment fraud. We will suspend the affected account, treat the disputed amount plus a $50 recovery fee per disputed transaction as immediately due, and pursue collection. Accounts with two or more such disputes are permanently closed.

4. Effect on future service

We reserve the right to refuse future service to anyone who has initiated a chargeback against us, regardless of outcome.

5. Collection costs

Where amounts remain unpaid after a failed dispute, you remain liable for the original amount, the $50 recovery fee, and reasonable collection costs including third-party collector and legal fees.

Account verification and one-account rule

1. Accurate information required

Your account must be registered with accurate information: your real legal name (or the registered name of the entity you represent), a valid contact email you control, a working phone number, and a billing address that matches the payment instrument on file. You must keep this current.

2. Verification

We may, at any time and at our sole discretion, request additional verification — including a government-issued photo ID, a recent utility bill or bank statement showing your name and address, a selfie holding the ID, or a small refundable verification charge to the payment instrument on file. We do this when we see signals associated with payment fraud, when a chargeback is in progress, or when a service is being used at unusual scale. Failure to complete a verification request within seven days may result in suspension; failure within fourteen days may result in termination.

3. One account per customer

You may hold one account per natural person and one account per registered legal entity unless we have explicitly approved an additional account in writing. Operating multiple undisclosed accounts — to obtain promotional pricing twice, to evade a suspension, to maintain anonymity, or for any other reason — is grounds for termination of all accounts you hold without refund.

4. Consequences of false information

Submitting false, misleading, or stolen identification or payment information is a material breach. We may terminate the account immediately, retain any prepaid amounts, preserve relevant logs, and report the matter to the card scheme, PayPal, and — where applicable — law enforcement.

Sanctions and restricted jurisdictions

This section expands on Section 5 of the Terms of Use.

1. Lists we screen against

We will not provide service to persons or entities on the US Office of Foreign Assets Control Specially Designated Nationals list (OFAC SDN) or the US Commerce Department Bureau of Industry and Security Entity List or Denied Persons List.

2. Restricted jurisdictions

We do not knowingly provide service to persons ordinarily resident in, or to entities organised under the laws of, the following jurisdictions: Cuba, Iran, North Korea (DPRK), Syria, the Crimea region of Ukraine, the so-called Donetsk and Luhansk People's Republics, and any other region that becomes comprehensively sanctioned by OFAC during the term of these terms. We additionally restrict service to Russia and Belarus consistent with current US sanctions programs.

3. Your warranties

By registering an account, you warrant that you are not located in any of the jurisdictions above, are not listed on any of the lists above, are not owned 50% or more by any listed party, and will not use the service to deal with, route traffic to, or otherwise transact with any listed party or restricted jurisdiction.

4. Consequence of violation

A breach of this section is a material breach. We will terminate immediately, retain any prepaid amounts to the extent permitted by law, preserve and produce records as required by competent US authority, and may report the matter to OFAC or BIS.

Affiliate program policy

1. Eligibility

Any PinnVPS customer in good standing may enrol in our affiliate program through the client area. You must comply with all PinnVPS terms — including the AUP and this affiliate policy — at all times.

2. Commission

10% recurring commission on net invoiced amounts paid by customers you refer, for as long as those customers remain customers and the rules below are met. Discounts, refunds, and chargebacks reduce the commissionable amount. Setup fees, custom-build fees, hardware passthrough fees, and tax are not commissionable.

3. Attribution

Last-click attribution within a 90-day cookie window. We do not pay multiple affiliates for the same referral.

4. No self-referrals

You may not earn commission on your own account, on accounts that share your payment details, or on accounts you control through any other person. Detected self-referrals result in clawback of commission earned, suspension of the affiliate account, and — for repeated or fraudulent cases — termination of all PinnVPS services you hold.

5. Brand and paid-search restrictions

No paid-search campaigns on "PinnVPS" or close misspellings without our prior written approval. No misleading advertising claims. No impersonation of PinnVPS, our staff, our support, or our partners. Use the brand assets we publish in the client area; do not modify the logo or wordmark.

6. Payout

Commissions accrue in your affiliate balance and are payable, on request, once the balance reaches a minimum of $15 USD. Payouts are issued in cryptocurrency (BTC, ETH, USDT on TRC20 or ERC20, or LTC) or as account credit applied to your own PinnVPS invoices. The on-chain amount equals your USD balance at the time of payout; we absorb reasonable network fees. Affiliate balances may not be transferred between accounts.

7. Right to review and freeze

We may review unusual traffic patterns, freeze affiliate accounts pending investigation, claw back commission tied to fraudulent traffic, and — for material or repeated abuse — close the affiliate account with no further obligation.

Account credit balance

1. What account credit is

Account credit is a prepaid balance held on your PinnVPS account that can be applied to invoices for any PinnVPS service. It does not earn interest and is not transferable to another account or another person.

2. Top-up

You may top up your credit balance from the client area in amounts between $5 and $300 per transaction. Top-ups are charged through the same payment processors as service invoices.

3. Refundability

Account credit funded from a refundable payment instrument (card, PayPal) is refundable to the original instrument within 30 days of the top-up, less any portion already applied to an invoice. Credit funded by cryptocurrency, issued by us in lieu of a cash refund, or paid out from the affiliate program is non-refundable.

4. Overpayments

If you overpay an invoice — for example through a duplicate transfer — the excess is applied to your credit balance. To receive an overpayment back to the original instrument rather than as credit, request it through a ticket within 48 hours of payment.

5. On account closure

Unused credit is refunded — subject to the rules above — to the most recent refundable instrument on file. Credit balances on accounts closed by us for breach of these terms are forfeited.

Cancellation and service lifecycle

1. How to cancel

You may cancel any service at any time from the client area at my.pinnvps.com. Cancellation takes effect at the end of the current billing period; refer to the Refund Policy above for mid-period refunds.

2. Disable auto-payments separately

If you pay via PayPal, cancelling the service in our client area does not cancel the PayPal billing agreement at PayPal — you must also revoke it inside your PayPal account. We cannot revoke a PayPal billing agreement from our side. If a charge is taken after cancellation because the PayPal agreement was not revoked, open a ticket within 48 hours and we will refund.

3. After due date — grace and suspension

Invoices unpaid 7 days after the due date result in suspension (the VPS powers off; data remains on disk). Invoices unpaid 30 days after the due date result in termination and permanent deletion of all data on the affected service. Within the 30-day window the service can be reactivated for the $20 reactivation fee described in Section 9.4 of the Terms of Use.

4. Data after termination

On termination we delete the active VPS and any rolling 72-hour backups associated with it. You are responsible for exporting any data you wish to keep before cancellation or termination.

Account security — your part

1. Credentials

You are responsible for keeping your client-area credentials, root credentials, console PIN, and any API keys confidential. Activity from your account is treated as yours unless and until we are notified of compromise.

2. Passwords and 2FA

Use a unique, long password for your client area. Where two-factor authentication is offered in the client area, enable it. We do not, and will never, ask you for your password by email, ticket, or chat — anyone doing so is impersonating us.

3. Keep your VPS patched

You are responsible for applying security updates to the operating system and applications inside your VPS. We may notify you of widespread vulnerabilities affecting common stacks; we are not obliged to.

4. Reporting suspected compromise
